Welcome to Aesthete Aquatics Academy! By enrolling in or participating in any of our programs, training sessions, events, or activities, you (the “Athlete” or “Parent/Guardian” for minors under 18) agree to comply with the following Terms and Conditions.
Please read them carefully before engaging with our services.
1.1. Eligibility:
All athletes must complete an enrollment form before participating in any of the programs or activities at Aesthete Aquatics Academy (hereinafter referred to as “the Academy”). Minors under the age of 18 require the consent of a parent or legal guardian.
1.2. Program Participation:
Participation in the Academy’s programs, training sessions, or events is voluntary (hereinafter referred to as "programs"). The Academy reserves the right to make changes to program schedules, coaches, and training facilities as necessary.
1.3. Code of Conduct:
All participants must adhere to the Academy's code of conduct, which includes respectful behavior toward coaches, staff, fellow athletes, and use of the facilities. Misconduct may result in suspension or removal from the program without a refund.
2.1. Fee Structure:
All program fees, including training sessions, competitions, and other events, must be paid in full prior to the start of the program unless a specific payment plan has been arranged with the Academy. Fees are due regardless if swimmer is actively training or not. There will be no pro-rating of fees.
2.2. Refund Policy:
All fees paid are non-refundable except security deposit which is subjected to 1 month notice in withdrawal. Any withdrawals must be made in writing to Aesthete Aquatics Administration. No refunds will be issued for missed sessions, early termination, or voluntary withdrawal from a program.
2.3. Late Payment:
Late payments are subject to penalties or additional charges. The Academy reserves the right to deny participation in any program or event until all outstanding payments have been settled.
3.1. Assumption of Risk:
Participation in aquatic activities, training sessions, competitions, and any related services provided by the Academy involves inherent risks, including but not limited to, physical exertion, bodily injury, illness, or death. Athletes and Parents/Guardians acknowledge that such risks cannot be entirely eliminated.
3.2. Waiver of Liability:
By enrolling in any program or activity at the Academy, the Athlete (or Parent/Guardian for minors) hereby voluntarily assumes all risks associated with participation. The Athlete and/or Parent/Guardian waives any and all claims against Aesthete Aquatics Academy, its owners, officers, directors, employees, coaches, agents, and contractors for any injury, illness, or loss sustained, including death, whether caused by negligence or otherwise. Please note that members are required to be responsible for their own medical insurance coverage when participating in all training and events.
3.3. Indemnification:
The Athlete and/or Parent/Guardian agrees to indemnify and hold harmless Aesthete Aquatics Academy, its owners, officers, directors, coaches, employees, agents, and contractors from any and all claims, actions, suits, costs, damages, or liabilities arising from participation in the Academy’s programs or activities.
3.4. Medical Consent:
In the event of any injury, accident, or illness, the Athlete and/or Parent/Guardian authorizes Aesthete Aquatics Academy to arrange for medical treatment deemed necessary, and agrees to bear the financial responsibility for such treatment.
4.1. Compliance with Safety Guidelines:
All athletes must adhere to safety guidelines provided by the Academy's staff during training sessions and competitions. Failure to comply with safety instructions may result in removal from the program.
4.2. Health and Fitness:
It is the responsibility of the Athlete (or Parent/Guardian) to ensure that the Athlete is in suitable physical condition to participate in activities. A physician’s approval may be required for certain programs or competitions.
4.3. Medical Conditions:
The Athlete or Parent/Guardian is responsible for notifying the Academy of any pre-existing medical conditions, allergies, or medications that may affect the Athlete’s participation
5.1. Proper Use:
Athletes are required to use the Academy’s facilities and equipment properly and in accordance with the Academy’s guidelines. The Academy is not responsible for any personal belongings lost, stolen, or damaged during the use of the facilities.
5.2. Damage:
Any damages caused to the Academy’s facilities or equipment by an Athlete may result in the Athlete or Parent/Guardian being held responsible for repair or replacement costs.
6.1. Content Ownership:
All content, materials, logos, designs, and information provided by the Academy during training sessions, events, or programs are the property of Aesthete Aquatics Academy. They may not be reproduced, distributed, or used without the prior written consent of the Academy.
7.1. Photo and Video Consent:
By participating in the Academy’s programs or events, the Athlete and/or Parent/Guardian grants permission for Aesthete Aquatics Academy to photograph, film, or record the Athlete during activities for promotional or training purposes. These materials may be used on the Academy’s website, social media platforms, or marketing materials without compensation.
7.2. Opt-Out:
If an Athlete or Parent/Guardian does not wish for photos or videos to be used, a written request must be submitted to the Academy prior to participation in any program or event.
This Agreement and any disputes arising from it shall be governed by the laws of Singapore. Any legal action must be brought in the appropriate court in Singapore.
If any provision of these Terms and Conditions is found to be invalid or unenforceable, the remainder of the Agreement shall remain in full force and effect.
By becoming a member, enrolling in, or participating in any programs, training sessions, or activities provided by Aesthete Aquatics Academy, you acknowledge that you have read, understood, and agree to be bound by these Terms and Conditions, including the Waiver and Release of Liability. Your continued participation in any Academy activities or use of our services constitutes your acceptance of these Terms and Conditions. Aesthete Aquatics Academy reserves the right to change these Terms and Conditions without any prior notice.
